Can I Travel to Australia While My Permanent Visa Application Is Being Processed?
Some Australian permanent residency visa applications can take considerable time to process. A common question I receive from clients is whether they can travel to Australia while they are waiting for a decision on their permanent visa application.
The answer is yes.
Lodging an application for an Australian permanent visa does not, by itself, prevent you from applying for another type of Australian visa while you wait.
This can be particularly important for applicants who are separated from their families while their permanent visa application is being processed.
Can I Visit Australia While Waiting for My Permanent Visa?
In many circumstances, a person with a permanent visa application being processed can apply for a temporary visa that allows them to travel to Australia.
The appropriate visa will depend on the reason for travelling and the applicant's individual circumstances.
For example, a person may want to:
• visit their spouse or other family members;
• undertake further study;
• travel to Australia for business;
• spend an extended period in Australia while waiting for their permanent visa application; or
• make regular visits to Australia while remaining primarily overseas.
There is nothing inherently wrong with applying for another Australian visa while a permanent visa application is being processed.
However, it is important to remember that each visa has its own eligibility requirements. Having a permanent visa application pending does not automatically mean that another visa will be granted.
Visiting Your Spouse While Waiting for a Partner Visa
This can be particularly important for Partner visa applicants.
I recently assisted with a case where the sponsor was living and working in Australia while his wife was living in India. Naturally, she wanted to spend time with her husband while their Partner visa application was being processed.
His work commitments, however, made it difficult for him to travel regularly to India.
I was able to assist her with obtaining a long-term, multiple-entry Visitor visa, allowing her to make regular trips to Australia while the Partner visa application continued to be processed.
For couples who are separated during a lengthy Partner visa processing period, being able to spend time together in Australia can make a significant practical and emotional difference.
What About Studying in Australia While Waiting?
Visiting a spouse is not the only reason someone may want to travel to Australia while waiting for permanent residency.
Some applicants decide that they would like to undertake further study in Australia while their permanent visa application is being processed.
I have assisted several clients in this situation by arranging Student visas that allowed them to study in Australia while they waited for their permanent migration outcome.
Other applicants may have professional or business reasons for travelling to Australia. Depending on their circumstances, a different type of temporary visa may allow them to travel to Australia for those purposes.
The important point is that a pending permanent visa application does not necessarily mean that you have to remain outside Australia until a decision is made.
Do I Need to Apply for a Different Visa?
If you want to travel to Australia while waiting for your permanent visa application to be processed, you will generally need to hold a visa that allows you to enter Australia.
The appropriate visa will depend on what you intend to do in Australia and your individual circumstances.
For example, someone wanting to visit their spouse may have different options from someone wanting to undertake a course of study or travel to Australia for business purposes.
It is therefore important to identify the appropriate visa and ensure that you satisfy its requirements before applying.

Will Applying for Another Visa Affect My Permanent Visa Application?

There is no general rule that prevents an applicant from applying for another Australian visa simply because they already have a permanent visa application being processed.
However, the two applications are assessed according to the requirements that apply to each visa.

What If the Other Visa Application Is Refused?
There is also no guarantee that an application for another visa will be successful.
A refusal of a temporary visa application does not necessarily mean that the pending permanent visa application will also be refused. The applications are assessed against their respective legal requirements.
However, the circumstances of any refusal should always be considered carefully, particularly if there are concerns about the information provided or the applicant's circumstances.
